I get that, but the spite I'm referring to is the dude also allegedly claiming all his artwork back that he put towards the project (something which isn't even legally possible, as it was supposedly contracted work that you can't retroactively take down)
He kept the ownership of the artwork according to the contract at least according to the blog post, how that exactly works within the legal realm of game production I do not know.

This is the part that seems the least kosher to me. How the hell would SPurple expect that to remain secret for any meaningful length of time? It's not like the western indie cartoon porn scene is that huge and that's a very distinctive art style.
Unless he himself or whatever team he might have collected leaks it, how would anyone have found that patreon page?




And again I would like to stress that my eyes are seeing this as an outsider/newbie, Im not clued into all the previous drama for the people involved. Heck I hadnt played any kind of nsfw game untill maybe 2 months again, Im proberly one of the freshest virgins around these parts :)

The same way he would have gotten funding. I mean that issue of how it got "leaked" is even more fishy.

Contracted work remains in the ownership of the person who contracts you, the agreement they had would mean that the artist retains the rights to his artwork (meaning he can freely redistribute it at his own discretion) but that does not allow him to retract work that he's been paid to do. What this means is that Breeding Season does not own the artwork and that they do not have any rights to distribute the artist's work outside of the game it was contracted for.

This is also when you hire somewhat to do an advertisement for your company and he creates a campaign around a mascot figure. The company would have the rights to the original advertisements and can distribute it as per the original contract, but then hiring a different artist to make a different advertisement with the same mascot isn't allowed (since the mascot was created by an artist who holds the rights to it)

There's variance depending on the exact phrasing of the contract itself, but it's completely unfathomable that an artist can retract work he has been paid for.

Simple searching around, it's really not too hard to find these things if you're looking. There was absolutely no chance of him getting away with it if what Hbomb suggests is true, and there's also absolutely no chance of him not being aware of this, which just lends to the suspicion that we are well short of the full story here.

Wow, it actually came crashing down in flames. Like in a big way.

I honestly think they really just lacked overall direction. It looks like they split the management of the team into two distinct parts, with Hbomb handling one part, S-Purple handling the other, and neither of them actually getting along. They needed a supervisor sort of role who could not only exercise control over the others but also had to take responsibility for everything that happened.

Out of curiosity, is anyone going to be supporting S-Purple's new project?

With a patreon user name like that it does seem like it was meant to be secret, until whatever time it would go public and actively seek funding.

This part does seem to make my guess about Hbomb just being inexperienced or at the very least completely unknowledgable about this specific part, unless the whole "made him my partner" part somehow could interfere with it ?

If there's anything almost two decades on the internet have taught me, it's to NEVER underestimate the stupidity and persistence of fans, so yes, absolutely there will be people who think the guy is completely innocent and being set up, or are just desperate for the game, or just don't have a damn clue that Breeding Season was ever even a thing.

After reading the entire post.. All I'll say is you need to be friends with your partner.

As an artist currently in a project, I'll take the lessons here to heart and hope to prevent a similar chaos.

Unless he somehow managed to become a partner with a majority share then no, such decisions are outside of his control. Then again, I have no idea if they even properly registered themselves as a business or how they phrased their contracts so this is mainly speculative, suffice to say it'd be extremely difficult to accidentally sign away all your rights as the owner over something like this.

To me, this just sounds like Hbomb trying to pass it off as him being a tragic victim (of all of Spurple's bullshit and technical fraud) and valiant hero (distributing Spurple's artwork to the masses that he owes by leaking his dropbox)

Until he pays back every dime he still has leftover from Patron donations for a project they'll never see, he's going to be the main villain desperately covering his involvement in this story as far as I'm concerned.

Completely pointless though, as (just about) all this artwork was already available on public domain, it's a grand gesture of valiant altruism that is ultimately nothing but sleight of hand by a known crook.

And it's working, people are already praising him for it all and excusing his involvement in this debacle ("clearly he cares!").

Once again, another game originating from the LoK forums dies yet again, proving once more nothing ever gets finished over there. If it ain't dying, that emulating, partisan-like kickstarter he begat is going to kill interest outright, then it will start dying.
Looks like you called it. Honestly, it's amusing to look back on this thread and then look at the present and see people taking his excuses at face value. He wasn't any better at not delivering on what he was paid for back then, I don't see any reason to believe that's not exactly what is happening now.

As a layperson, isn't proving creatorship of an art asset a fickle thing? Theoretically, couldn't H-Bomb & co alter all the existing artwork just enough to call them original creations?

Sure, it would be an insane ton of work, but wouldn't it be better for them to salvage the project that way than abandon it?

I mean, what is S-Purple going to do, sue him for breach of contract and prove that the art assets were originally his?

My opinion is this is a case of two people - one, who clearly did not understand how to run a project and lost control early on, and another - an artist with WAY too much ego and greed. There is not a single person to point to blame, so that is pointless. What is needed is for every other indie adult game dev to learn from this. And I can only hope that this does not ruin Patreon for these types of games...I would say all - steer clear of games with these names attached...

I never did support the patreon, because I did think progress was very slow. But I was still looking forward to the project being completed. Thats sad.
