If you pirate you copy Batman looses his ability to glide. Which is game breaking. Quite possibly the best pirate protection plan I've ever heard, amounting to "fuck those guys!"

Best guess is that they stuck the code for gliding in with the code that checks if you're using a disk. But I have no experience whatsoever with programing so...>.>
