They won't be in trouble, period. This is not a fan remake or resale of Pokemon. It's a indie game made with mechanics that happen to be used in Pokemon, all the original creativity is FAR more than enough to label this a parody. And parodies are legal everywhere. Any lawsuit filed won't even reach a court and if it does, it'll be instantly dismissed.
Jeez, I was just joking with my earlier two comments. The author, DLSite, and (I wish I could say "we all") a few of us here know that this had nothing to do with Nintendo or copyrights. As the dev said, this was DLSite "attacking" his work. They have had the demo, they checked the demo, they knew the content.

I can tell you that I've been playing for a few hours now and am hardly half way through the game.
Side note: This game is damn hard when you can't speak moon runes. Don't know what I'm doing! It's a lot of fun though, really captures the fun of pokemon with some not-to-bad sprite sex.

Also, has anyone heard if it's actually going to be on the English Dlsite? I'd probably buy it if so. I still haven't been able to buy from the Japanese Dlsite.
Edit: Actually went to read the situation surrounding the Dlsite release. That's pretty shitty of them. If anyone can tell me an easy way aside from Japanese credit cards that I can use to actually support this game and purchase it, please do.

Thieves? It's hardly theft if no-one loses anything. Many of the people here simply CANT buy these games for a variety of reasons, and it's not like the author loses revenue over copies made by others.
That really does make these kinds of temporary embargoes quite ridiculous (and even if theft was the case, it'd still be quite clowny) I mean really people, do you think folks will just think: "Oh damn I can't fucking wait till monday, I'll totally buy it now because waiting 3 more days? Don't put more weight behind my words than there is, I am merely having a good laugh at the expense of people doing silly things to act out their beliefs, as tends to be the core of most non-fictional comedy. And I'm sure the people here are reasonable adults and don't need someone jumping in to suss things, relax, have a laugh, move on with your daily lives etc.
